I140 through employer I am not working with
Hi -
I got my labor approved (PD Dec 29th 2003) in RIR, CA on Dec12th 2005. I do not work for this company any more (left the company in 2001 way before they filed for my labor). The company is struggling but is very clean. Now if I file 140 as future employment and assuming that theywill definitely fail in ability to pay issues.. will I have any other option ?
What makes this more important my H1b extensions depend on this (already 8th year extension).

Thank you very much United Nations. Can you please eloborate how can I fix the issue from my side even before I file I140? The employer is reasonably cooperative. Can you please give me my options. Can I please call or email you. I know you have been helping so many people.
