Hello All,

My I-140 has been denied and Im waiting for the denial notice. I think it could be either Ability to Pay or Education.

My case was filed under EB2 category as I have a Master Degree from INDIA. The Labor stated that a master degree in computer science is required. I even have an evaluation done for my degrees from MorningSide.

I-140 was filed on July 07 and received the Denial on Jan 09.

Has anyone been in this case of a straight denial? Is so, what was the reason and how did you react? Did you apply MTR or an Appeal?

Any inputs will be greatly appreciated.

Any update on your case. Did you appeal? What happened to the Denial? Did you receive any document of denial and reason? I am in a similar situation and applied around same time. Any update would be appreciated. Thanks

I have seen many denials without an RFE. But they can be overturned with an MTR. Did you file one?
