My labour was approved in Dec 2006 for EB2. Due to a mistake by my Employer/Attorney I140 was approved in EB3 in Feb 2007. Now I am looking to port from EB3 to EB2. At the time of my first I140 I had BSc (3 Years) and Masters (2 Years) in computers and 6 years experience in India. Now I have 5 Years US experience added to that.

My question is; can use the same EB2 labour and file an new I140 in EB2 in 2011. If I do that will I get the same Dec 2006 priority date.
