I-140 denied and appealed

Hi,
My labor got approved and i submitted he i-140 before expiring my labor. USCIS returned my i-140 package and asked to resubmit with new forms (My lawyer used old form). When we resubmitted my labor date is expired and my I-140 got rejected. We appealed again and its in initial review.

What are my chances of i-140 getting approved? If i do premium processing, is there any advantage? Its almost 8 months over. Please guide me.
