I-140 filed when I was 21. Am I eligible for CSPA?
My parent filed the I-140 when I was 21, same year before I turned 22. I believe there is a 1 year grace period, I am not so sure exactly how the CSPA applies. My question is, am I eligible for the CSPA?
During the filing of the I-140, my name is included in the petition, and the lawyer told my parents that by the time the application becomes approved, Ill be aged out then.
My DOB is 11/00/1986.
I-140 filed on 09/00/2008.
Priority date is 04/00/2008.
Also, right now, I am under OPT which will be expiring soon. I will go back to F1 if the visa is still not available. Although I used to be on the H4 category I believe.
Now, the application is still on pending because as of today, the processing dates are still back in 2005.
Any input anyone please? I am to have a meeting with my parents lawyer one of these days but I will definitely go for a second opinion regardless of what the primary lawyer will tell us. I just wanna have an idea where I stand. Thanks!
