My I-140 was denied after RFE for ability to pay was submitted under premium processing. I am a general dentist and have been working for the same company since January of 2009. I was working part-time when labor cert was approved and priority date was established. I was not making the proffered wage at that time so I increased to a full time position. Since that time Ive been making the proffered wage and my year to date salary shows that I am currently on track to making the wage before the end of the year. What evidence should I provide when re-filing. If my employer has already paid me (by year to date) the necessary wage- is this not enough proof??
