impact of EB2 NIW on future applications
Currently, I am on F1 and I am planning on appyling for EB2-NIW. I have a few questions. I will file I-140 and I-485 separately. Suppose my I-140 is denied:
1- Can I extend my I-20 later?
2- Will my OPT application be approved after my graduation?
3- Can I change my status from F1 to J1 after graduation?
4- Does it affect any of my future I-485 applications?
5- Can I change my status to H1B directly from F1?
I have looked into your post and consulted my personal database but I am afraid i dont find any answer. So I suggest you should consult any immigration expert and give him all the details. I am sure you will find your answers.
With Form I-140 denial and not filed the Form I-485, you may have diffficult to extend the I-20, but you should get OPT application approval.
