Q: evidance for ability to payMy I-140 was submitted last month to NSC. My employer included 2 years (04/05) of tax returns. Profits do not meet the wage however company assets are sufficient. We didn’t include the analysis. My TN application is still pending in VSC so I’m not working for then at this time and couldn’t provide W-2’s or pay stubs. Was the initial evidence sufficient to demonstrate the ability to pay? Should we expect an RFE? Any thoughts or words of comfort?
