I-140 with 16.5 years education

My details are as follows:

Education: 16.5 years in total
10 + 2 + Diploma in Electronics (3 years) + Post Diploma in Computer Application (1.5 years)

Experience during I file for labor:
7 years +

I have got my labor approved in EB2 category. But my lawyer said that its difficult to get my i-140 approved in EB2 category since I am not qualified for that. I dont know why had he applied for labor in EB2 category. :-)

My company also has a cleared labor for EB3. My labor application says education requied ie bachelors or equivalent. Do you think there could be any problem in processing my 140 in either of the category?

Thanks... There shouldnt be much difference in processing times between EB2 and EB3 provided you were not born in a country that is subject to retrogression. In these conditions you should file for whatever is a clearer case for you, probably EB3 because you dont have a masters. Is your 3 year diploma equivalent to an US bachelor degree?

Did NSC or TSC change stand on eduation? Service Centers were denying diplomas after graduation (single degree issue). I may be wrong.
