My I-140 was filed using substitute labor (EB3 PD oct 2002). This was denied due to not having a single 4 year degree. I have done a 3 years bachelors of Science degree followed by a 3 years B.Tech degree.

The first evaluator had stated that I have a bachelors in science and bachelors in instrumentation engineering and this is equivalent to a bachelors of electronics degree.

The officer stated that a 3 year degree is not equivalent to a 4 year US degree.

I-290B was filed and new course by course evaluation done. Now case has been transferred to AAO.

What is the processing time for this?

Should I withdraw this and re-file I-140 with same labor?

Please help. I am on 7th year extension of H1B.
