RFE on I-140 ability to pay
I would like your opinion on how to make this case more stronger. We are thinking to submit the below documentation so far.
1. Annual reports for 2003 & 2004
2. Statement of net annual income
3. Bank statements
4. Monthly balance sheets
5. Copy of all Pay stubs & W-2 of beneficiary
6. Copy of Form 941 & 940
9. List of all I-140 petitions pending and approved since including the offered wage of the pending cases and copy of W-2 for the
approved I-140s.
10. Identify all contractors paid, their duties and amounts paid to each.
Your help in this regard is greatly appreciated.

I have got an ability to pay RFE too. Would you mind sharing your ND, category (EB2 or EB3) etc...?
Also, I would like to know what are the documents they have requested for. In my case, they have requested for the following:
- 2003 and 2004 annual report of my company (also 2005, if available)
- 2003 and 3004 U.S tax returns of my company (also 2005, if available)
- You may also submit companys profit/loss statement, bank statement and - personnel records in addition.
- Documentary evidence for the difference between proferred wage and the pay stub
- List of all I-140 beneficiaries from my company with name, DOB and LIN no.
- W2s of above beneficiaries for each year of their employment
- My W2s from 2002
