Hi,
My case is like this
140 still pending ( over 6 months recieved date :26th july 2007, notification date is 17 sept 2007)
I recieved my EAD on 29 sept 2007 , Can i change my job at this time?
Thanks in advance!!
I am in the same boat...can we avail AC-21 at this stage?
Thanks in advance!
Okay...I just talked to my attorney, they referred me to this: http://www.uscis.gov/files/pressrele..._AC21_8403.pdf.
According to it, one needs to have an approved I-140 with pending I-485 for 180 days (6months), you can read rest of the details in the document. I know I dont fall under that category so it cannot happen for me. Sorry guys, false alarm...thanks to all those who were planning to reply...LOL!! (I know no one was). Frustrations keep building!!!
okay...Correction to the information above:
"You dont need to have an approved I-140 (just delayed 180 days) since the applications are filed based on an intended employment and not existing employment."
The only problem I see with this is, if the previous employer pulls your I-140 you are (as I understood the text) screwed i.e. your I-485 will be denied as well...since there is no approved I-140 for portability of I-485 to take place. So, unless you REALLY REALLY REALLY trust the "previous" employer...wait till I-140 is approved and 485 is 180 days old...Read details here: http://www.uscis.gov/files/pressrele...ntrm051205.pdf
I am not an attorney or anything...just writing what I read from the press releases on uscis.gov. See links about and if you find something better please share...
