140 processing - RD or ND

Please let me know if 140 processing times is based on receipt date or notice date?

Im a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only 140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

In theory it should be based on the receipt date - thats what they officially claim. But I looked a little bit at trackitt spreadsheet today... Well, my impression is that ND still matters somehow. This is just an impression, nothing more. For example, I sort the result by RD and can see a bunch of those green approved stripes around my case (RD=June 14, ND=July 05), so it seems like USCIS started working on mid-June. But sorting by ND gives a completely different picture, there are almost no approvals close to my ND within a week in both directions. So probably youre right, your friend will be approved earlier. Or may be not Some people get approvals in 3-4 months, some get stuck for a year, its all random.
