I864 - Affidavit of Support Question?
As on I864 Instructions say If Spouse Doesnt qualify for 125% poverty guidelines Intending Immigrant can be joint sponsor
Question :
1) As we are stuck with only this one to send to USCIS , Can anyone let us know Do we need to file 2 I864s ( One by me and One by my spouse ) ? Fillable boxes in I864 form talks about Information of Sponsor Only but doesnt talk about Joint Sponsor information to provide
2) Who will be prime Sponsor ? Myself ( who didnt made 13k last year ) or my spouse who make 50k
3)Which forms Do we ( Myself and Spouse Need to fill ) ?

Who is filing for who? Are you a citizen filing for your noncitizen spouse, or vice versa?
Is the noncitizen spouse inside the US? If yes, is that with legal status and a legally authorized job?
Your answers to the above questions will affect what you need to file (or if you are eligible to file anything in the first place).
I am US Citizen filing for my Intending Immigrant ( Non Citizen Spouse on H1B Visa ) and Yes he is in US and we been living together from past 1 yr and Yes he been paying taxes from past 4 years and working fulltime
