My application for my wife has been approved. I am wondering how much the rest of the process will take. I will need to file an I-485 for permanent residence. My wife will be waiting in Peru until the process is over.
Does anyone have an idea on what will happen next and how long it may take?
Thank you,
Lyndell
Hi Lyndell,
Did you receive a notification in the mail saying the I-130 was approved?
Can you please share your timeline?
I just filed the I-130 for my husband and was wondering how long the process took you. Also, which service center was your application processed at?
Thanks!
An I-485 is filed with USCIS only IF the intending immigrant is in the U.S. in a lawful status.
IF the intending immigrant is abroad, they will file a DS-230 with the State Department for Consular Procxessing.
IF you are a USC, the process is quicker because the immigrant visa is (legally) "immediately available" but there is still a processing delay to get a visa.
IF you are a greencard holder, the visa must become available and "current" as per the Visa Bulletin which is published monthly by the State Department.
In any case, you will have to file an I-864, Affidavit of Support with evidence of sufficient income. NVC will contact you about the I-864. The State Department will also send notice as per instructions that you have supplied to your wife when it is time to start the application process abroad.
Good Luck,
Post Decision activity I-130 - what do I expect next?
