My husband and I were married in 2009 and he now has his two year permanent resident card. I wanted to know if I divorced him before the two years were up, would he have to go back to his country? I am curious because I feel he has used me for the green card, and he has cheated on me. Any help???
Yes, he will have trouble getting a Permanent GC if you divorce him specially if you divorce him because of him not being faithful and his infidelity, he has conditional GC at this time and will only be able to get a permanent GC after your divorce through a waiver if he proves he was not at fault for divorce and did not entered the marriage to evade the immigration laws of the United States by clear and convincing evidence to USCIS.
