I got married for a USC on 10/1/10 and we had filed the AOS package. As a reply I have received a letter that my husband needs to send proof of income or find a joint sponsor. Since my husband is a freelance artist and cannot prove his income, we need to find a joint sponsor. This letter also said that we have 87 days to either prove my husbands income or find a joint sponsor, but it does not say if we do not find a sponsor for that time.
So my question is: After those days are passed, what would happen to my status and what I would need to do?
I need your help because I do not have that many days left.
Please if there is anyone in a similar situation or might know anything about it. HELP
IF the Affidavit of Support is not filed and approved, then the I-485 will be denied and you will revert to your prior status, if any. From the date of denial, if not in a valid status, you will start to add on unlawful presence (this would in addition to what you already have, if any).
An 1-485 may not be appealed but you will have an opportunity to file a Motion if a sponsor can be found in that short additional time. If you cannot find a sponsorr in time, reply anyway, even if just to beg for an extension, so it is not denied as abandonded because that type of denial can only be overcome by proving that the requested evidence 1.) was submitted, 2.) the RFE was not received because it was sent a wrong address or an old address after you submitted a change of address, OR 3.) the requested evidence was irrelevant. If a Motion is filed and then denied OR if no Motion is filed and you dont depart, if required, OR if there is another reason, an NTA (Notice To Appear) may be issued to place you in removal proceedings.

Why he cannot prove his income? He didnt file tax returns?
Does he or you have substantial assets (at least around $55K combined ... more if he or you have dependents)? Assets can be used to offset the income requirement.
