Hi, Everyone i need a suggestion in this matter before i jump to some kind of decision. I came to states back in 2004 with f1 visa. My family were supporting for my expenses but suddeny back in 2006 i had a problem, my dad was diagnos with cancer and had to support my family for treatment since that day i quit my studies and started supporting my family for treatment and today he is doing fine and survived ...inorder to help my families i had to work full time and now i am out of status. I have been working in tax and even file for tax each year. April 2010 i got married with a gal who has a green card, she has been in this country for 1 and half year now and now it is 2011 and i am going to be a father pretty soon now what should i do... Am i still be able to apply for green card through my wife looking at my situation, what shouldbi do i need some good information regarding this matters....hope you all guys can help me out with a good suggestion or what should i do.....please help me out with this matter....

You have to wait until she gets her US Citizenship.
You can only adjust status and have your overstay forgiven if you are a spouse of a USC as long as you have a legal entry into US, which you do have.
Until then Im afraid you have to stay under radar and try to not get caught by USCIS.
That is the only option you have at this point to stay in US.

Living your life under a rock is what you need to become competent in for the next couple of years, if you are caught by Sheriff Joe Arpaio, then deportation is your ultimate destination and 10 years banned from entering the US. If the question is, can you get a green card NOW to support your wife and newborn, at this present time, absolutely NOT!!! Your wife will need to become a US citizen and sponsor you, which your unlawful presence will be forgiven by USCIS.

The key issue which I am interested in is this: How were you able to be employed without proper documentation? Did you buy some social security card or green card from someone? Did you claim to be a US citizen in the I-9 form? If you can answer these questions, then it will give us an idea on your chances for a green card in the future. For example, if you claimed to be a US citizen in the I-9 form, then you will NEVER obtain a green card, because such a claimer is like a sword ripping through your flesh...death kiss.
