Hi all,
I am LPR of US since 2007. I have filed I30 for my wife recently.
After the I-130 approved, can my wife visit me in US. I know usually people say cant. However, given the big visa retrogression of family based recently, could USCIS let her in to visit me?
She has no intention to overstay her B-2 visitor visa.
Thanks
Does she already have a B2 visa? Has she already visited the US since being married to you, and always left without overstaying? Did you select consular processing for Q22 of the I-130?
If yes to all of the above, she has a decent chance of being allowed to visit again.
Sure she can attempt to visit you. Whether she is granted entry and for what duration, will depend on her past immigration history, her citizenship, etc. Just be mentally prepared for the worst case scenario.
After the I-130 approved, can my wife visit me in US.
