My mom was in states since 1994 and was deported in 1995 since she had filed for aslym case. She over stayed and in 2008 october we had the immigration come to our house to find her. She did surrender herself and then left from united states in Feb 2009. I became a us citizen and now was sponsoring her. Everything in states got approved. Her file got transfered to Mumbai consulate, she went for the interview and the officer told her she has no record of her coming back to India and accused her saying maybe she served prison time which she did not. Now we have to email some courier service VFS with her full time line from 1994 to 2009 stay in USA. This is absolutely absurd and I am very upset cause, I want my mom back soon. How will I know that if the US Consulate in Mumbai got the email from VFS and how much time this procedure will take, since they did not take her waiver either. I know the visa was not going to get issued but still Why the US immigration has to harass people for no reason. Please help if anyone was in this situation.
You need to work with a competent lawyer for any hope of success. This is not a DIY case. We are dealing with a failed asylum case, issuance of NTA (I am assuming this happened once her asylum case was denied), overstay, arrest and deportation.

Not too sound curt or judgemental, but your mother had this coming. She abused her status while she was in the US. She failed to leave when she was asked to. She continued to mock immigration regulations by overstaying and only left after she was finally tracked down and arrested. I am surprised you think there is "no reason" for the treatment she got. Mind you, the treatment you described above should not be called harrasment. The consul officer in my opinion wss doing what his job is. I apologise if this offends you but I am only calling a spade a spade.

It will be a good idea to invest some $$$ in a competent lawyer. I am confident you will NOT be seeing your mom getting of the airplane in the US anytime soon. She violated US laws and filed a frivolous asylum case, because as far as I am aware, solid asylum cases are usually approved. Here is the timeline as your post: she arrived in the 1994, Clinton was a new President, ordered deported in 1995 ( she disregarded this notice), file for an asylum. You dont indicate when her asylum case was adjudicated. She continued to live in the US till 2009 (Clinton left the White House in 2000, GW Bush came to office, and now Barack Obama is the leader of the free world, this is when ICE came to deport her back to India for an order issued in 1995. As far I can see, she was never persecuted or tortured when she returned back in India, which makes one question her asylum claim. She showed up at the US Consulate to interview for a visa, wheres the persecution?
Unfortunately, your mother abused US laws, and you now have the unmitigated gall to claim US officers enforcing US laws are mean? You are upset because you want your mother back in the US, how impressive? She is NOT an American citizen nor a green card holder, admittance into the US is a discriminatory process, those who seek to remain in the US for long-term without proper documentation are routinely denied visas, as they should be. Unless you have an immigrant visa petition, then all visitors visa request are carefully examined and some are denied the visas. It is absurd because someone is enforcing the laws of the country, which you had no problem with their violation while your mother remained in the country for close to two decades without proper authorization. It is highly possible that your mother is banned from returning to the country for a period of 10 years. Your mother is NOT being harassed, she is a subject of clear violation of US law and now seeking to gain entry after being deported.
The US Consulate will get your email, the question is are going to be happy when you get their decision? If you are offended by my post, guess what is going to happen when she return to the US Consulate and the officers look at her colorful immigration record? She overstayed and has a ban. A ban is not waived automatically by your filing a a USC. In addition, it sounds like she did not leave upon her deportation order. I expect you will need to go to India to live with her anytime soon.
One of the largest group of illegals in the US are Indians who have overstayed. This explains why so many visas for legitimate visitors are denied. Stop your whining! Her problems are of her own making. She is no better than someone who sneaked across the border. She lived in the US as an ILLEGAL ALIEN; if you as a USC do not understand this, you need to retake your civics class. If you do not like it, you are free to leave too.
