need some advices please

1) I am an F1 student and married to a green card holder in 2009, but i never updated my marriage status on the I-20 and used the I-20 one time to renew my F1 visa after getting married. My wife became a US citizen in 2010 and we will have our interview soon, do you think this will be an issue? What would be a better explanation in case the VO questions about this?
2) Also my F1 status will expire in about 3 months. I heard that I dont really have to care about the F1 status (even if I became over-stayed) as long as Ive received the I-485 receipt. Can someone verify this for me please? Does the I-485 receipt here mean the notice of acceptance of 485 application?

You have nothing to worry about. It is a non-issue, concentrate on proving relationship at the interview. Best of luck. FYI you dont have to care about your F1 status after filling, but still my advise would be to stay legal does help at the interview. If you received receipt that means that your I-485 is accepted, if they need any info they send a RFE. Hope that helps

Contrary to an up-beat post by Ravi, you have problems ahead of you with regard to misleading immigration officials when you renewed your F1 visa. You were married at the time of renewal, but you chose to lie to USCIS officials by claiming you were single, which is a problem. In your post, you acknowledge concealing this fact from the immigration officials, and you want someone to conjure up a cogent explanation for your own fornicaboobery? Really?

An expired F1 visa wouldnt be a problem as far filing for immigration, your problem is the issue I mentioned above. Likely that USCIS will have access to your DS-160 as they usually have access to all of your immigration related documentation, including student visa applications. Notice of I-485 means acceptance of filing and a determination is currently been made on whether you qualify for a green card or not. Personally, you are going to be grilled by USCIS should they realize you got married in 2009, renewed your student visa and deliberately mislead them on your renewal, because your clearly had immigration intent at that time. It would have been best to disclose you got married, and they make a determination on whether to deny your visa renewal or not, but your wifes citizenship now could have brought you back into the US without any problems. Prepare to explain yourself thoroughly on this issue.

Had you not renewed your F1 visa the whole thing would be a non issue, even if you fell out of status, marriage to a USC would make you eligible to permanent residency with no problem; however since you misrepresented your marital status at the time of F1 renewal I think you may have harder times ahead than normal. Strictly speaking, since you were married to a GC holder at the time of F1 renewal, and intended to reside in the US, you were not eligible for a non immigrant visa. Its hard to think of advice other than be truthful in the interview, thoroughly document the bona fides of your marriage and be prepared for a potentially tough interview. Best of luck.
