Hi everyone, Thanks in advance for any advice you can give me...

So heres my situation. My fiancee is from China, here doing a masters in education (she earned her bachelors in physics back in China). Shes going to graduate this August, and I think she has either a 6month or 1year work visa after that.

Im a little lost where to start with the whole green card process, and more than anything, how long it usually takes. My main concern is that lets say the green card process takes a long time (a couple years, lets say) ... her work visa only lasts one year after graduation. Would she have to leave once her work visa expires, and stay out of the US until she receives her green card?

Any help would be greatly appreciated! Thanks!

Her immigration options depend on YOUR status. Are you a USC or a greencard holder?

Since she got a visa already she is admissible. Hopefully there have been no legal problems since entry. What type of visa is she on? It may make a difference if she is on a J-1 that is subject to the INA 212(e) 2 year home residency requirement.

Thanks for the fast reply! Im a USC, born here so my status hopefully wouldnt be an issue.

When you say admissable, what do you mean by that? Sorry, Im new to all these terms here. Ill have to double check the type of visa she has now, but I believe shes on a student visa. There have been no legal issues for her, and she has no record back home either.
