My uncle petitioned my mother about 10 years ago and it is finally here. My mother and I are already in United States, too painful to mention that my mother brought me here illegally when I was very young. We consult a lawyer and he said that we need to go back to our home country for the interview. We wanted to go back for the interview, but we are afraid that I am going to get the 10 years ban. My questions are
1. Will I get the 10 years ban and how?
2. What are my chance of getting approve?
3. Should I take the risk?
You and your mother will both face the 10 year bar once you depart US.
No chance of getting approved.
Your only chance to get a GC without getting the 10 year bar is to adjust status in US as a IR of a US Citizen provided you have a legal entry into US.
If I were you, I will not take the chance of going to the interview as there is no hope of getting approved.
You both entered without inspection or did you overstay after being legally admitted?
