My daughter,who is US Citizen, sponsored my son-in-law for Green Card. He sent a divorce notice to my daughter last week, just barely completing 3 years of the marriage. There is no reason for this notice and we felt he cheated us. I need help in how I can cancel the Green Card immediately. Though they were marriage for 3 years, the green card sponsoring was applied 2 years 9 month back(not 3 years yet). Has he as yet obtained the unconditional (10year) green card?Although I feel your pain, your feeling he cheated you has no place in USCIS lore. You need to have CONCRETE PROOF that he entered the marriage in bad faith solely for the purpose of obtaining immigration benefit. Now if he "played his cards right" and has ample evidence which could indicate he entered the marriage in good faith, there is very little your daughter can do. In fact, you the father can do NOTHING. It is your daughter who can TRY to provide evidence of fraud, even then she has an UPHILL battle.
In any case what do you mean by he is cheating "us"? What has he done to cheat YOU in particular?
It is sad. Hopeful and lonely people get taken advantage of all the time. The process to immigrate is lengthy and complex. What exactly has already transpired to this point? She filed an I-130? She filed I-130 and I-864? She filed I-130, I-864 and he filed for either an I-485 or a DS-230? Does he have a conditional greencard? Did they complete an I-751 and he just got the 10 yr greencard in the mail?? Did he obtain a 10 yr greencard directly without a conditional period? Different circumstances result in different possible actions. Be more specific.
