hello....I came in us in 2008 on F-1 visa and than I had arrange marriage after 3 months with u.s citizen in 2008....In 2009 I got conditional green card for 2 years....We are now on divorce stage...staying separate since year...So after divorce will I get permanent green card or what will be my visa status?
Can anyone give me answer?
If you do not file for and receive the unconditional green card, you will start accruing illegal presence after the divorce and become deportable. Say bye bye to the F-1 visa because having shown "immigration intent" by applying for and getting a green card, you are no longer eligible for a F-class visa. Now it is possible to file for the unconditional green card after divorce IF youre able to show the marriage was entered into in good faith, not easy though.
If you can prove validity of the marriage, you can apply to remove conditions (get a 10 year GC) even if divorced. Either read up on the process or enlist the assistance of an attorney.
When exactly does your 2 year GC expire? You need to make sure you file an I-751, even if the divorce is still pending.
