Hi all,
My mother in law is sponsoring her brother family, and now the case is with NVC and they ask for I-864. Her brother family has himself, wife, and 3 kids --> total 5
Im asked to be on of the I-864 since her income level doesnt support all additional 5 person.
I know that my mother in law needs to file I-864, and I also need to file I-864. My question is both of us need file one I-864 for the whole family or one form for each person in her brother family?
Thanks for your time and respond.
If you live in the same household as mom-in-law, you stick to the I-864A as a co sponsor. That way if she dies, you are off the hook financially. If you file an I-864 as a joint sponsor, then you are on the hook until the sponsored immigrant works for 10 years, naturalizes, dies or looses the greencard. READ the I-864 sponsors promise section carefully. MIL files one for the main beneficiary and copies for the rest. If you do the I-864A it is only one copy (a contract between you and MIL). If you do the I-864 then it is one official form and copies for the rest. One set of evidence for each original I-864/I-864A.
IF you file I-864 or I-864A it must be a separate one, in addition to the I-864 your mother-in-law will file.
For the derivative family members, you dont file a separate form for each person, you just list them on question 9.
Thanks BigJoe5 and Jackolantern,
Hi Jackolantern,
To summarize your instruction:
1. My mother in-law will only need to file 1 I-864 for the her whole brother family (total 5 members)
My mother in-law doesnt work for the last 10 yrs, therefore, we are not going to submit any supporting document other than US citizen cert.
2. I will need to file only 1 I-864 form for his whole family (himself is the intend immigrant, and 4 others list in question 9)
I will send along with 3 yrs tax return with my W2s, 6 months worth of paystubs, my employment verification letter from my company, and ofcourse my US citizen cert.
My income is above 125% poverty line for my household size, and plus 5 of the sponsorred family.
Could you help to advise if above statements are correct, or I need to add anything else. Thanks for your advices and time.
