Hey guys .. Next month I will be submitting an I130 application for my spouse. I have the following questions and I would appreciate your input.
1) My wife visited the US before on a tourist visa. She have lost her passport with the visa on it and I94 number. The form asks for the I94 number and since we do not have it, what should we put for an answer ?
2) My wife obtained an F1 visa to come to school here but she never used it. Again the passport with the visa stamp is lost. How should we handle this?
3) We are both divorced and our divorces took place overseas. I know I need to get the divorce decrees translated to English. After I translate the decrees, do I need to get them certified from the U.S. embassy as an authentic translation of the original or would the stamp from the translation center would be enough?

Is she in the US legally now? They only want the I-94 number if she is in the US now, and they only care about the I-94 she got at her most recent entry to the US, not old I-94s from prior trips.

When you say she never used it, does that mean she never entered the US with it, or that she entered with it but never attended the school? There is a difference; if its the second it could mean big trouble for her.
Thank you Jackolantern ... I am sorry for the confusion. She is actually overseas. The missing I94 number is from her only trip to the US. Since that is her most recent visit to the US and we do not have the number, what should we do?

I said they only want the I-94 number if she is inside the US. Since she is outside the US, she is not supposed to have an I-94 because she should have surrendered it when exiting the US. So leave the I-94 number and date arrived as blank, or write N/A.

So she got it approved, but then didnt use it to enter the US? Good. Because if she used it to enter the US and then didnt attend school, she could be banned from the US for immigration fraud.
