hey guys, iwant to file 1-130, but am wondering whether it should be done together with form 864 , or should i wait till 1-130 is aproved then file 864? which is the procedure please?
If you are filing for someone who is abroad, file the I-130 only. The I-864 comes later in the process.
See:http://travel.state.gov/visa/immigra...info_3178.html for how the State Department handles it. Depending on the circumstances of the case State may charge a fee.
If the beneficiary is in the U.S. and eligible for a concurrent adjustment application, the I-864 may be included in the adjustment filing. The I-864 may also be submitted later in the USCIS processing. USCIS does not charge a fee.
some people are telling me that form 1-130 should be filed together with affidavit( 864), for aspouse who is abroad. which is the way foward guys coz my wife is in africa?
For a spouse who is abroad, file I-130 without the I-864. They will request the I-864 later, after I-130 approval.
file form 1-130and form 864 jointly or separately
