Can Filing FOIA Trigger Notice to Appear or Removal Proceedings?

We would like to file a FOIA to check whether my spouse might have been sent a Notice to Appear when he fell out of status without his knowledge before going ahead to file for his green card.

Our fear is that filing a FOIA might trigger USCIS to issue a Notice to Appear since he is out of status?

Any ideas if that is the case?
