USC(thru employment) mother apply green card for children...

I saw many topics about this question; even sticky forum. It wasnt help much. The information is too board...anyway...

My friend aunt has 4 children. Two are over 21 (unmarried). Another two under 21. All of them still in school(not in the united states)

1. How long does it take for them to apply green card? Shes thinking to apply for 2 under 21 and 1 over 21. (Current)

2. What form does she need to fill out?

3. Does she need to have enough income?

If anyone has a link to provide, it would be great.

The form that starts the process is the I-130 Petition for Alien Relative. It may be filed with USCIS by an LPR or USC petitioner but each petitioner has a specific list of family members that they can apply for. Your naturalized friends USC aunt can apply for Immediate Relative (IR) of a USC status for her under 21 (unmarried) children.

She can file for a family preference visa, F1 status for the unmarried son/daughter who is over 21, F3 if married. NOTE: F3 can bring spouse and children.

The form is at www.uscis.gov The visa availability for the IR is legally "immediately available" but in reality there is a wait based on USCIS and State Dept. workloads (5 to 18 months?). This is the first step. She will have time to worry about the other steps later.

Check "family" immigration section on USCIS website for instructions and forms. The income requirements are specified on the website. If she is unable to determine the process, she should consult an attorney.
