I have quite a similar case to an earlier thread, but I am the one being petitioned by my U.S. citizen wife, who committed adultery with a love child. We are still in the process of getting myself a green card.

Weve been married since 2006. Early this year, my wife and I welcomed our first child. Until my wife confessed to me that I was not the father of our son. She did not put a fathers name on the birth certificate & left it blank. Out of guilt? Or shes not even sure who the actual father is. Last September was my AOS interview. When asked, we admitted I was not the father of the child and that my name is not on the birth certificate. The officer still asked us to submit it. We mailed it as requested. It will take90 days for the decision. What are my chances? If denied, am I able to appeal?

My wife made a hurtful mistake. I still love her, were still together. But Im just not sure what will happen next.

Get a DNA test.

Without legal proceedings the child born during the marriage is considered to by your child. You need to consult a family law attorney if you do not wish to be the childs father since there will be legal steps that must be followed which are dictated by state law.

You have been married for over 4 years, I think you will be approved. The fact that your wife did an immoral act of sexual relations with another doofus which resulted in a love child shouldnt cast doubt on your marital state. Her immoral behavior cant cast doubt on your own moral character, if you were the father of a love child, then USCIS would clearly nail you for adultery, which could have cast doubt on your marital intentions. When did you submit this certificate?
