Girlfriend is illegal, im a USC, can we marry through grandfathered LIFE act

My girlfriends grandfather petitioned for her Mother, which included the rest of the family, to become citizens via I-130. Their priority date is January 13, 1998. I want to marry my girlfriend, and was wondering if she falls under the grandfathered LIFE act and i can simply petition for an adjustment of status without worrying about her being deported since her family came over illegally in 1996.

Did your girlfriend enter the US legally? Meaning, did she ever had a visa issued under her name? If this is the case, you can marry her tomorrow, file for all immigration paperwork. If you a tenacious fellow, this thread has a thread on filing for green card yourself, I would immense myself in that thread, especially the first page and learn about filing on my own as much as I can. Once you know enough to file, you can do so. This thread will help tremendoubsly with filing all your forms, till you are successful.

Here are couple of issues, in the past 10-12 of her being in the US, if she has never committed any crime like entering a steak name in another being behind, never stole or misrepresented herself as a US citizen, or was in deportation proceedings, she is all squaure to get a green card. If she has a copy of the approval notice for the old I-130, you can use that as part of your filing to make sure USCIS can locate her file and assign the proper filing category-immediate relative of a US citizen. Visa overstays are forgiven, she wont be in trouble at all.

If she sneaked into the country, then it might complicate matters for you.

Her family entered illegally. Which brings up the question about the LIFE act and if she falls in it as the drop off date was January 14, 1998. So with their date being January 13th, does that qualify her as being grandfathered under the LIFE act and prevent her from being deported when i file for adjustment of status when we are married?
