Is it considered Deported if you are returned from the Airport?

Someone asked me this question recently and I was not sure how to answer.

in 2002, they came to the US on a visit visa but came on a 1 way ticket. The immigration officer was not ok with this fact and asked her to return immediately (and didnt let her enter the country). Nothing was stamped in the passport or a letter given. They came on 1-way tickets prior to this many times and returned.

Since then, they have visited the US many times and returned and have had no issues. They had a 10 year visa issued in 2008 as well.
They are now looking to file for GC and were not sure if this one incident would be considered as being deported?

That is refusal of entry, which is not the same as deportation.

Even though nothing was stamped in their passport, the incident probably was recorded on their system, and they will have to say YES if asked whether they were ever refused entry. But they can say NO if asked about being deported, and that incident will not affect their GC eligibilty.

Thanks The airline which allowed her to board the plane with a one way ticket to the US on a tourist visa was also fined some $$$. It is considered a violation to allow a non-immigrant to board the plane with a one way ticket, unless they are holding a A, G, H, F, J and other types of visa which requires residence in the US for an extended period, all tourist visa requires round trip tickets.

You friend wasnt deported, you can only be deported if you entered the country and committed a crime or overstayed your visa, got caught by ICE and sent packing on a free ticket paid for by the US govt. She should be fine.
