I recently obtained my Green Card as a derivative from my wife asylum, Class AS7.

My question is, I have a 16 year old daughter from a previous marriage who I want to bring over to the US. Can I apply for her Green Card directly or does my wife has to do it as her step mother?

You can apply yourself as a GC holder for your daughter, you have the custody for your daughter right?

So unless your wife will soon be eligible for citizenship, it would be faster for you to apply for your daughter directly. The backlog is currently under a year for under-21 children of permanent residents (recently it used to be as much as 4 years).

Note that you may have to clear up custody agreements with the other parent, if your daughter is going to leave her home country permanently before age 18.
