I am US citizen and recently married to non-US citizen who is working on H1 B in a different state. I am in process of filing for I130 and I485 concurrently. Can my spouse move with me and leave the job?. Does she need any temproray visa while I130 and I485 is in process?
Once the I-485 is filed, she needs nothing more to remain in status. She can leave her job.
Wow, straight answer. The very same information I am looking for. Thank you RealCanadian.
To be safe, she should wait for the I-485 receipt before quitting her job. Because until you get the receipt, you dont know if USCIS has initially accepted it (they may reject it due to an error in the paperwork), and if they dont initially accept it, she would be out of status if she has already quit her job.
Does she plan to go into another job ASAP after quitting, with little or no gap of employment? In that case, she should wait for the EAD before leaving her job.
Can my wife leave job (H1 B) after marriage to US citizen and filling I130 and I485
