2 year conditional residency has expired and 751 is in pending decision mode with uscis. U.S. Citizen Spouse is trying to annul the marriage due to vindictiveness, although the marriage was in good faith. I am trying to get a divorce instead.
Can anybody please tell me if there is any adverse effect of marriage being annulled in court on my 751 petition. I have already invested 30K with no results in the court...honestly I am tired and dont have any money left on me.
I was thinking of just let my spouse get the marriage annulled if it doesnt have any bad impact on my immigration status.
Legally, annulment means the marriage never existed, which has implications for your GC. In what state is "vindictiveness" grounds for annulment of a marriage of over 2 years?
The comment above is correct.
But its not easy to get annulled. Your spouse will need a good lawyer and evidence to prove that you/he has mental/physical/fraud issue etc. In most cases, its easier to get divorced than to annul.
So probably tell your spouse that he/shell waste a lot of money for lawyers to get an annulment case go through. Instead, divorce is more simple for him/her and less affects your GC.
In what state is "vindictiveness" grounds for annulment of a marriage of over 2 years? I believe the OP meant the USC spouses vindictiveness is leading them to attempt the annulment, not that the grounds for annulment is the OPs vindictiveness.
