Okay so i am 20, and currently live in the united states, ive lived here for most of my life and even graduated high school here, however my mother never filed for me to get a greencard or anything for that matter. You may be wondering how i got here in the first place well thats a long story. I am a canadian and i was born in ontario, however my father is in jail and blah blah blah, i dont have any family in canada and i moved in with my mother in the states, ANYWAY. So i moved out of my moms house when i just turned 19 and moved in with my boyfriend, in april 29, 2010 i filed for a I 130 with my mother and step dads help (as long as i paid for it they would sign whatever i needed. I have YET to hear back anything. Now a lot of people are freaking me out telling me i should have filed for both the i 130 and the 145 i think and i didnt do that. I filed the I 130 and once that got approved i would file for the 145. Now im starting to get really upset because i just want to be able to go to university, and get a job, and HAVE A BANK ACCOUNT, but i cant.
I dont know whats taking so long, i dont have the money to afford a lawyer, but i am in desperate need for help.
Why is my i 130 so long i gave them more then enough papers i ever gave them my damn highschool transcript.
So i need to file the 145 now or later.
I just want my green card
Help please =(
How long have you been in the US? Did you enter with a visa?
Its not 145, its the I-485 you need to file.
Was your mother a US citizen before you were born? If not, is she a US citizen now?
Did you get the I-130 receipt? It is not necessary to wait for I-130 approval. File the I-485 (and other associated papers such as the I-765, I-131, I-693 medical) with a copy of the I-130 receipt and youll be able to get an EAD and Social Security number that will enable you to get a bank account, a job, a drivers license, and attend school.
How long have you been in the US? Did you enter with a visa? Canadians dont need a visa to enter the US. The relevant question is whether the OP entered the US legally.
