Siblings son married and over 21

US citizen sponsored brother in India
Brothers son is now 29 yrs old and married, was 18 when I-130 was filed
The notice from NVC to submit $400 per beneficiary includes brother, his wife and the son as well

Is the son still eligible?
Will the son be covered under Child Status Protection even though he is married now?

Date current and I-130 approved: Dec 2009

If he is married, he is no longer consider a child and cannot get the protection of CSPA.

Even if the brothers son were still under 21, once he got married he lost eligibility to be a derivative beneficiary tied to his parents application.
