We had our marrige based interview this morning & it was really easy. We got married 7 yrs back but living together for the last 8 years. My wife being a Canadian resident came to visit her family in USA back in 2001 & we met in a party & got introduced. After that we started communicating over the phone & fell in love. She again came back to USA in 2002 & since then never left. In the mean time 2003 we got married & till now we got two precious kids that were born in US.
This year February I got my US citizenship therefore fter that I filed for her ( I-130/ I-485/ I 864 / I 765 back in April, 2010. I was worried cause she came from Canada & never went back. But in our interview all that officer asked was if she has entered USA legally & its funny cause if someone is a Canadian PR why the hell that person needs to visit US illigalli ???????
Anyway long story short all that officer ask me as I applied for my wife was where I work & thats all. After that he asked my wife if we together got any kids ( We got two, one 5 & half yrs old & 3 & half yrs ). Mrriage certificate, kids birth certificate also how my wife obtain Canadian PR status & thats all.
So over staying is no matter what so ever as long your entry is legal & you are married to an US citizen. So lets make that clear out there who has similar cituation like mine. Dont worry at all even you over stayed but as long you entered legally & married to an US citizen you should be just fine.
Our entire interview only took 5/7 minutes. Officer never even asked to see any photos or anything. Just kids birth certifictes & marriage certificate thats all. After asking 3/4 questins IO told my wife your case is very simple & standard & Im going to appove your case. Youll be receiving your card in 30 days. Man that was way to easy.

So folks please dont get nervous & just be yourself & ud be just fine. Any question feel free to as me. by the way from the time to apply till approval all it took is only 4 moths.

By the way although my wifes case was approved this morning I didnt receive no E-mail update yet. Guess updates dont happen while case transfered to local office.
Who cares as long the IO already told my wife case approved & shell be receiving her PR card in next 30 days.
Interview was extremely nice & easy. So dontr worry but just be happy.

After verbal approval by the interviewer, supervisory review may be necessary, and the supervisor can deny the case. Such a denial is not going to happen in your case, given the length of your marriage and the existence of your children, but there may still be some formalities to complete to make the approval final and official, and those formalities can take weeks.

The reason the officer asked that was in 2001, Commonwealth citizens with Canadian PR status were able to enter the USA without I-94s or visas. Thus their entry was identical to those of Canadian citizens. So the officer needed a verbal declaration that she was inspected upon entry.

To marry somebody who lives in the US. Canadian permanent residence does not give automatic permission to enter the US legally. Thanks Jack for your quick response. In your second comment what I really meant is since my wife was a Canadian PR therefore she didnt need to enter US illigally. First of all back in 2001 Canadian PRs never even required any visa to get in US. Even 2002 when she last came to US same thing. We didnt know shell be staying here permanently at that time & well get married. But that happend officially in 2003 in a court house & since then we both are happily married with two precious kids.
My wife never got into any legal issues ( arrest) while here never left since she got here 2002, nor she even tried to work illigally. She was a staying home mom who takes care kids with her best effort.

Before applying I knew its going to be a simple case cause we are with each other for the last 8 yrs therefore I decided not to use any attorney ( thinking what an attorney had to prove our bonfide marriage). My only fear was if USCIS raises her over stay issues but in this forum Ive found in numerous times that USCIS takes this matter under consideration while applicant is married to an US citizen provided the entry was legal. And thats exactly right. Cause officer first asked my wife if she has entered legally but when my wife informed the officer about her Canadian PR status IOs response clearly showed he dont want to proceed with that issue. He just asked my wifes birth certificate & our marriage certificate to copy that ( went inside ) & came back saying well, your case is very straight forward & Ill approve it & you will receive your card with 30 days.
I knew it was simple but I just couldnt belive at that time it would be that simple. I seriously doubt our case needs any supervisory attention.
