Hi, friends!
I am in a very bad situation now. Need some assistance and advice!
So, I applied for the green card (family based through marriage), recently got RFE (request for evidence). My husbands income (our income) doesnt meet the requirements. It is very difficult for me to find a joint sponsor because no relatives or close friends here, I tried it by other (people I met here) but no result. So, my husband doesnt have any property in America. I dont have any income or property to help him to meet the requirements except of a car in my country but I am not sure if I can use it. I dont know what to do. May be somebody has the same situaton.
Actually, my mother has some property in my country (not include where she lived) and i will inherit it later, now she let my live and use these at any time or sell it. But I dont know if I can use or mention these property in my case because I am not really the owner I only have the right to use or sell it at any time.
How much more does he need to meet the income requirement?
It is about $10-11.000.
His income is $10-$11K below the required amount? That would be an income of $7-$8K if your household size is 2. Thats strange, as its below minimum wage for a full-time job. If hes actually earning more but hiding the rest of the income to avoid taxes, you and he might have other problems.
I assume your husband is a US citizen? If yes, your combined eligible assets would need to be 3 times the income shortfall, so that would be $30-$33000.
You cant use that property owned by your mother unless your name is added to the title, or it is sold and the money given to you. You might be able to list the car, but youd need a certified appraisal along with evidence of how much you owe on the loan (or proof that you own it outright, if there is no loan), and only the net after subtracting the loan balance can be used.
What about cash and savings accounts, anywhere in the world? Jewelry?
