Hey everyone. good day.
I have an urgent query and would be really obliged if someone can guide me.
Back in 1998 an I-130 was filed for my mother by his brother (F4). At that time i was under 16 years of age. Then she got her GC in 2010 and my father too. But me, my younger brother and sis (we) didnt got it although we were mentioned on original petition of 1998. Note that in 2010, when petition comes to front of the line, we were all above 21 years of age and umarried.
Now my question is, is there any law or rule by which my mother can file I-130 for myself and younger bros and sis with original petition reference of 1998.
Alternatively, she will file fresh I-130 for everyone left out - but since we all are above 21 years of age and unmarried - our preference category will be F2(B), waiting time for which is 8 years approx.
Thanks and regards
zeeshan.
How old are you now? When in 2010 did the priority date of the original case become current? When was the I-130 approval date? What attempts did you make to get added for the final stage? Did you file I-485 or DS-230?
Are you inside or outside the US? If inside, legally or illegally?
You may be eligible for a green card via the original case under the CSPA, depending on the specific details of your situation.
Thanks for reply. Response to your questions:
I am 29 now.
In march 2010 priority date become current
I-130 was approved in 1998 (im not 100% sure of this)
We make no attempts to get added to the list in final stage due to lack of knowledge - my fault!
DS-230 was filed for my Mom and dad in 2009 and they got GC in 2010 march. No DS-230 was filed for me or younger bros / sis as NVC didnt ask us to do so.
Im outside of USA.
What is CSPA? can you guide me a little more. Really thanksful for your help. thanks.
I search web for CSPA and have read the whole story. I think i have delayed the matter. They want to file I-824 within 1 year of visa becoming available..... ;(
