Im so hoping Im posting this in the right place. So here is my current Situation. I came her 3 years ago on the VWP. So I was inspected, overstayed. Im engaged to a US-Citizen. We have been together for almost 2 years. I only, the other day realized my passport will expire in 11 days, so now we want to get the marriage liscence. We live in NJ. Where in NJ can I go to get it without being questioned about my status or when I go what will they ask me ? I was given a SSN before when I came here as an Au-Pair years ago. But I wont be able to use that, is that correct ? Has anybody else been through this process in NJ ? Im very worried that they will question me. Or want to see proof of residency when I go, which I cant provide.

I would check with the city hall of your city (or where you plan to get the marriage license) what documents they ask for.
I got married in NH and they did ask for an ID and a SSN, but never checked my status here (overstayed).
The SSN you got as an AU-Pair will be the same number once you get your AOS, so you can use that one.
The basic requirement will be a proof that you are what you say you are i.e your ID. With your passport and your SS card, you should be fine with that.
The other thing is if you are a resident of the city from which you want to get the licence. The law requires either one of the couple must be a resident of the city before they can issue a marriage licence. They request state ID for this but if you dont have it, your recent utility bills like electric bill or a HOME phone bills will be fine. And if you still cant provide that, a notorized letter from your landlord confirming that you live in his/her property will be good. Am from NJ too and i was in your shoes like 6 months ago, i hope this help.
