My Father (LPR) was filled the I-130 visa petition for me and my brother (unmarried son over 21 years of age - F2B category) and it was approved in March 2005.

My father(greencard holder) is in India since more than two years and their re-entry permit (for two year) expired on 24th April 2010.

I am still unmarried and my brother is married.

We have just received Agent Selection form from NVC.

Please guids us for the same.

Your father needs to get a returning resident visa (SB-1) and go back to the US to restore his permanent resident status. If he doesnt do that, your immigrant visa wont get approved.

Your brothers I-130 is null and void.
You can proceed with your I-130 if you wish, but there may be issues. Bear in mind, your father has probably abandoned his PR status.

1. if I proceed with I-130 but my father (petitioner) PR status has abandoned, Is there any changes for me to get visa as?

2. If my brother (married) proceed with I-130, Is there any changes for him to get visa as he received agent selection form??
