I am a green card holder and I am applying my daughter who is over 21 to get a green card. She is holding a student visa and having a job as OPT in the United States. Her visa will be expiring in 2011. Can she stay in the United States after her visa expired until she get the green card?
P.S. I heard holding US citizen can do it but not sure for the green card holder.

Even the children of US citizens dont get that privilege if theyre over 21.
Sorry, but she will have to leave the US when her student status expires, unless she can get another visa like H1B.
Jack is right, or she can take up another coarse of study to extend F-1, actually filing now for her might complicate things a bit now because if she has to go to Canada or something to extend the visa whether H or F , there is a question about a petition being filed on her behalf and bears a negative impact on a non immigrant visa decision, if it extends while she is US that would work great, besides if your citizenship is not that far away, you are better off filing as a USC.
