Hello everyone!
I am trying to put all the papers together for status adjustment ( filing i-130 and i-485 together) and was hoping you could help me with a problem we are running into. My husband (US citizen) has been working for the US Air Force (Air National Guard) for 5 years although his income for the last 3 years didnt meet the USCIS income requirements. Recently hes got a full time position in there that will bring the income level up to
$ 42 000-45 000 a year. The job starts on July 6. Question: can he file i-864 as my sponsor? If yes, what information/papers is he required to get to prove his income level since he did not even start the job yet? ( we requested the Letter of Employment, he also signed a contract).
Thank you for your help and your time!
If somebody is on Active military duty, he has to furnish proof for only 100% of the poverty level as income. General public has to prove above 125% of the poverty level.
He has to get a letter from his commander for the same.
Please look at the USCIS page for military personnel.
Thank you for reply! He is not on active duty, the position he just got is federal
Submit the employment letter with the application; at the interview he can supplement that with paystubs.
