Hello,
I am on OPT (post-F1) and my girlfriend is a GC holder. She has recently applied for citizenship because shes eligible for it. Were thinking of getting married this year, and wondering if we could get married before she gets the naturalization certificate (hence becomes a USC), and then submit the other forms (adjustment of status, etc...) to USCIS after she becomes a USC?
Or, should we just wait until she becomes a USC then get married and do the paperwork?
Also, does AOS have to be related to either of us? Can AOS be a family friend (of mine)?
Thanks.
By AOS do you mean Adjustment of Status, or Affidavit of Support?
Marriage time does not matter.
No friend who understands the financial responsibilities of the affidavit of support is likely to sign. It is a very big responsibility. Why does your girlfriend not qualify financially? Why have you not applied for H1B so that your income could count? You need to review the USCIS requirements for meeting the income requriements to see the options that the two of you have to demonstrate the necessary financial resources so that no affidavit of support from other than your soon to be wife is required.
