Hi,

I am getting ready to file for i-130 and i485 along with EAD. I am on h1b and I got married to a US citizen few months ago.

I have some questions about the filing and I would really appreciate any pointers/help with this:

1) For the i765 (EAD) form: Question 16 of the form is on eligibility categories. I have written [c] [9]. Is this correct for my category?

2) Does my wife also need to fill out G-325a form?

3) My wife does not work. So how do I show that I am sponsoring my self? We have filled out i-864 under my Wifes name and I am just planning to send my tax return documents, paystubs and letter from employer as proof of financial standings. Will this suffice or do I need to do anything else?

4) if I am concurrently filing for my i-485 and i-130, I have heard that the fee for EAD and travel document (parole) is exempted if the forms are filed concurrently? Is this true?

5) The i-693 medical examination was done about 2 months ago. I have the sealed envelop from the doctor. I have still not filed because I was waiting for my birth cert. to come from India. Will this delay cause any problems?

2. Yes, with the I-130. You need a send a photo of her with the I-130 application

3. She has to file I-864 as she is your sponsor. But you can supplement it with your income. Has she filed taxes before? You might also need a co-sponsor who is a US citizen/LPR.

4. Yes, the fee of $1010 for I-485 includes EAD and AP processing costs

5. Not sure about this. Someone else can probably chime in..Check the instructions for I-693, I am sure it will have information regarding this.

The results of the medical examination are generally valid for only 12 months. Applicants should schedule the medical examination as close as possible to the time they file for adjustment of status.

For #3: She has filed taxes but was only a student and was working part time ( less then 10k annual income for the last two years)...
However the total household income (line 24c) that adds up in the form i-864 is a lot more (after I add my income) then the national average. So do I still need a co-sponsor?
Do I also need to write a letter explaining this?

Do I also need to write a letter explaining this? Yes. She is your primary sponsor and you can include your income as someone living in the same household. In that case you wont need a co-sponsor.

There is another thing that I am not a 100% sure of. If your income is being used to supplement the petitioners income, then you (the beneficiary) must provide evidence that you will keep the same income source (job) for a period of 6 months from the current date. This means you might need some letter from your employer. I am NOT sure about this. So read the instructions again.
