Immigration Site

I have to apply for removal of GC conditions in January 2010. MY husband is in jail, and should be released in the beginning of next year. Would I have any problems getting my 10 year GC? What is the chance of us having an interview again?
Do I have to let the immigration know that my husband is in jail? Because being in jail he can put the same address on the application as mine.

Please advise!
