Hi there

I need someones help, my husband just received his green card april 2009..hes canadian and i am american we planned to move to the US (NY) in september, so we have been back and forth to the US since hes received the green card, but we dont want him to lose his residency, and we arent moving to the US now til january 2010...what do i do? its about 3 months away? we cant apply for the re entry permit bc that takes wayyyy too long to receive...he hasnt been out of the US longer than a month..

Anyone have similar experience? will they take his green card away?

should he apply for a re entry permit? arent they gonna keep asking why he hasnt moved yet, he does come back and forth into the US from canada like every 2 months is that gonna be a big deal til the new year comes?

Dont worry. Once every 1-2 months is enough to maintain the card from April to January. No reentry permit necessary.

The bad news:
- If this pattern is repeated for much more than a year, his GC might be in jeopardy.
- Residence requirements for obtaining citizenship are more strict than for maintaining the green card. When he applies for citizenship, they may decide not to count this April-January time frame towards the 3 years required for citizenship, thus requiring him to wait until January 2013 instead of April 2012. But if you can afford to lose the fee, he can go ahead and target April 2012 anyway, and see what happens.
