Hi All,

Here is my share of frustration with USCIS. I sent my I 751 application to remove conditions with all kinds of evidences on Jan 24 and was received by vermont office on feb 4, 2009. By the way it is a joint application. I did my biometric on Feb 24 and saw an update on 25th. After that nothing, nada. Sometime in July when I saw people who applied during the same time were approved, I was excited. I thought my turn was soon. Nothing came in July. Since USCIS was claiming the pocessing time was six months, in August I called to check what was going on. Obviously the customer rep didnt have anything new. She just repeatedly read what I can see fom my account. However she offered to do "service request" and she told me to wait for a month to 45 days and call back if I dont hear from them. Within two weeks I got a letter which looked automated letter telling me that it is under review. I called back sometime two weeks ago. THis time USCIS has (I think) changed their way of handling calls. The customer rep asked me a set of questions which sounded like they have them prepared for all callers, and finally she gave me two emails and asked to email one of them and wait for atleast 21 days. If I dont get any reply, I should email the second address. Fortunately, when I emailed the first address, I got a response telling me that it is under review and you will hear from them soon. Yesterday, I got a letter from vermont. Saying my application is denied.

The reason for denial is they said they have sent me a notice asking fo evidence and I was given until August 1 but the letter was returned undeliverable. That is cazy!!! Really this is wack (as whitney houston said). I have not changed my address and we got everything through the same address including the last denial letter and they are telling me one thing that cucial was returned?

The letter also states that I can ask to reopen the case but I have to send form 290 with another $585 and I dont think that is fair. I know the world is not fair but this seems too much. There is nothing I did that can be taken as a fault and they want me to pay to reopen the case.

NOw what do you think I should do, call them, contact a lawyer or ..... I will appreciate if someone with such experience comments.

Unfortunately, you have no choice but to pay the money and file the form. US Immigration is unfair and inconsistent, and there is not much you can do about it. They dont care about noncitizens.

A lawyer will cost more than an MTR.

NOw what do you think I should do, call them, contact a lawyer or ..... I will appreciate if someone with such experience comments.

I guess I have to accept the fact and pay this extra fee. Now the question is how about using a lawyer?

you raised a good point. Now that this unfortunate thing happened to me. How can I guarantee that it is not gonna happen again? I know there is no guarantee, but will an attorney make it easier to deal with them or does it make faster, or .....? Please comment.
